This page explains what happens to your information when you use this website. It describes what the site actually does rather than what a template says a website might do, so it is specific about the services involved and short on hedging.
The short version: we collect what you type into a form, plus basic technical details about how you arrived. We use it to answer you. We do not sell it, and we do not run advertising or tracking cookies on this site.
Who this is about
This site is operated by Misfit Marketing, a performance marketing agency working with direct-to-consumer ecommerce brands. If you have a question about anything on this page, or you want your information removed, email curtis@misfitmarketing.co and it will reach a person rather than a queue.
What we collect
What you give us. When you submit the enquiry form or download a resource, we receive your name, email address, company, the monthly ad spend range you select, and any note you choose to write. Only the note is optional.
What your browser tells us. Alongside a submission we record the page you landed on, the page that referred you, any campaign tags in the link you followed, your browser user agent, your IP address, and the time between the page loading and you submitting. That last one exists only to tell humans apart from bots, and it is the reason the form does not need a captcha.
What we do not collect. We do not ask for payment details anywhere on this site, and we do not knowingly collect anything about children.
Why we collect it
To reply to you, and to arrive at that reply already knowing something about your business. The spend range decides whether we are the right fit at all: below our minimum we will usually point you at someone better suited rather than take a call that wastes your time.
The technical details in clause 02 tell us which of our own campaigns and pages actually produce conversations, which is the same thing we do for clients. They are not used to build a profile of you as an individual or to target you with advertising.
Who else processes it
We keep the list short and we name it, because “trusted partners” is not a disclosure. Every enquiry passes through:
- Vercel hosts the site and serves every page.
- Supabase stores the enquiry in our database.
- Resend delivers the notification email that tells us you wrote in.
If the spend range you select is at or above our minimum, the enquiry additionally goes through:
- Perplexity, which researches your company from public sources so we are not asking you questions the internet can already answer.
- Anthropic, whose Claude models turn that research into a short written brief for whoever takes the call.
- Slack, where that brief is posted to a private internal channel.
Enquiries below our minimum are not enriched and never reach those three. No automated decision with a legal or similarly significant effect is made about you: the brief is context for a human, and a human decides whether to reply.
Beyond that we share information only when we are legally required to, or if the business is ever sold or merged, in which case the buyer would be bound by this notice.
Cookies and analytics
This site sets no cookies of its own. It does not use Google Analytics, advertising pixels, session recording, or cross-site tracking, and it stores nothing in your browser between visits.
We do use Vercel Analytics to count page views and see which pages get read. It is cookieless and does not identify individual visitors, which is why this site has no cookie banner: there is nothing to ask you to consent to.
How long we keep it
Enquiries are kept for as long as there is a plausible business relationship to have, and reviewed periodically after that. As a working rule we delete enquiry records that have gone nowhere after three years, and we keep records relating to actual client work for as long as our tax and contractual obligations require.
If you would rather not wait for that, ask and we will delete yours.
Your choices
Whatever jurisdiction you are in, you can ask us for a copy of what we hold about you, ask us to correct it, ask us to delete it, or ask us to stop using it. Email curtis@misfitmarketing.co. We will not ask you why, and we will not make you use a form.
Depending on where you live, those may be enforceable rights rather than courtesies, including under the UK and EU GDPR and under California law. We do not sell or share personal information for cross-context behavioural advertising, so there is nothing for you to opt out of on that front.
Where your information goes
We are based in the United States and the services in clause 04 are US-based, so if you contact us from elsewhere your information will be transferred to and stored in the United States.
Security
The database is reachable only from our server, never from your browser, and the credentials that can write to it are not present in any code this site sends you. That closes the most common way a site like this leaks its enquiry list. No system is perfectly secure, and we will not pretend otherwise.
Changes
If this notice changes materially we will update the date at the top. We will not quietly broaden what we do with your information and rely on you having read this page once.
